Speeding off is a serious traffic offence

Speeding off the road where you are not allowed to can be a serious traffic offense in NSW. A driver who commits a speeding offense may be dealt with accordingly under the Traffic Law.

Nowadays, it becomes very easy to catch drivers violating traffic rules through fixed speed cameras, mobile speed cameras, or highway patrol who have in-car videos which record video images and audio content. Individuals who commit speeding offenses may face several penalties such as disqualification or suspension of license.

Suspension of license generally follows different suspension periods. A driver with a learner and P1 license may only be suspended in a minimum period of at least 3 months. Such suspension also carries with it demerit points which shall be added in the driver’s record. Increased fines may be imposed for drivers who commit speeding and parking offenses in the operating school zones. If the driver exceeds the required demerit points, there is high possibility that he may suffer an extended suspension period under the Demerit Points Scheme.

However, in some instance wherein the offender can establish in the court that the patrol officers have failed to follow their own guidelines in patrolling the highways, the suspension penalties may be waived or cancelled. It should be noted that when the evidence of speeding offenses is obtained through unreliable means, the court can dismissed the prosecution and will free the offender from any criminal charges.

A person charged with speeding offenses can always appeal the decision of the RTS to suspend the license. Depending on several factors affecting the situation, the court can either uphold or dismiss the appeal or reduce the suspension period.

Dismissal of speeding offense charges entails good representation before the court. If you have been charged of speeding offenses, do not hesitate to contact experienced traffic lawyers for legal assistance.
